Family of fatal accident victim in Texas suing driver's employer

Many variables affect road and traffic conditions, and those conditions may have bearing on whether an accident occurs. How much traffic is on the road, weather conditions and how each driver is behaving behind the wheel are among many factors that affect travelers' safety. Driver negligence is often found to be the reason behind many serious auto accidents in Texas. When a fatal accident occurs, loved ones who survive a victim may pursue legal action against those deemed responsible for a crash.

A tragedy that occurred on a December 2015 morning apparently involved three vehicles. Reportedly, a van that was initially heading southbound veered across the center line and swiped a vehicle traveling north. Moments later, the alleged wrong-way vehicle is said to have crashed head-on in to a vehicle that was directly behind the first car that was hit.

The driver of that car and a passenger who had been riding in the van were both pronounced dead at the scene. The driver of the van that apparently drifted out of its lane was injured and taken to the hospital for treatment. In the aftermath of the fatal accident, a lawsuit was filed on behalf of the van passenger who died.

The wrongful death claim named both the van driver and her employer as defendants because the driver was apparently operating a company vehicle during the course of her employment duties. The leading factor that caused the fatal accident was determined to be driver fatigue. The lawsuit states that the employer should be legally accountable for allowing a fatigued driver to operate a vehicle for the company. Anyone who has suffered a similar loss in a Texas car accident is also able to seek restitution in court and is advised to enlist the aid of an experienced personal injury attorney to do so.
