A woman outside Texas reportedly suffered permanent injuries during the birth of her child. The baby was born in good health, but the mother began to suffer complications almost immediately following the birth. She filed a lawsuit, seeking damages for a birth injury she claims she suffered due to substandard medical care.
The woman had successfully given birth, without complications, to three other children. In this particular circumstance, she and her husband were looking forward to experiencing natural child birth for the first time after seeing the birthing center's advertisements on several occasions. The woman asserted that what the hospital advertised and what actually took place were two very different things.
She claimed nurses kept forcing her to do things the advertisement said she would not have to do, such as don a hospital gown and lie on her back for delivery. At one point, nurses are said to have used physical force to flip the woman on her back during labor, even though she wanted to remain on her hands and knees. Staff members are also accused of holding the baby's head inside the woman's vagina so the child would not be fully delivered, which reportedly frightened the woman's husband into thinking something was dreadfully wrong with his wife and/or child.
The woman suffered severe pain that remained long after she left the hospital. She eventually had to move in with her parents for assisted daily living due to her apparent birth injury. A jury recently awarded $16 million to the woman after deliberating for approximately nine hours. Anyone facing similar issues in Texas may seek guidance from a personal injury attorney experienced in handling these types of cases.
