What is the difference between a birth injury and a birth defect?

It can be easy to confuse the terms "birth injury" and "birth defect" if you are looking at the two at a cursory level. Both have a nexus at the time of birth, and both result in physical and sometimes mental conditions that result from a problem that takes place either before or during delivery. From a legal view, though, these two forms of harm are distinct, and this distinction can be important in terms of establishing potential liability.

Falls - A common cause of nursing home injury

The fact that residents in nursing homes in Bexar County, Texas and elsewhere throughout the United States fall more frequently than do older adults should not come as a surprise. The physical and mental conditions that make it necessary for older individuals to seek the care they can receive in a nursing home also attribute to an increased propensity toward falling.

Medical malpractice claims in Texas do not last forever

A doctor error, hospital negligence or other types of medical malpractice can leave a patient with a worsened medical condition or a serious personal injury. Fortunately, Bexar County residents have recourse under state law against a health care provider whose negligence results in injury to a patient. Patients must act quickly to file a claim or risk losing the right to recover due to the Texas statute of limitations in medical malpractice cases.

Truck company owner blames bridge for fatal truck accident

A semi truck accident that claimed the life of one person and injured three others was caused by the failure of officials to build a bridge higher, according to a statement by the owner of the truck company for whom the big rig was being operated. State officials apparently had a different view of the accident when they announced that the truck did not have permits from the Texas Department of Motor Vehicles to carry an oversized load.

Unless you are already an attorney, you probably do not spend much time thinking about what you would do in the aftermath of a serious car accident, in which you suffered injuries. For many people, the thought that comes to mind is, "That’s what my automobile insurance is for." But if bad fortune, in the form of another, negligent driver, strikes you one day, you may realize that there are many things you will want to know about your options.
